The Civil Plaintiff's Choice of the Civil Route

Despite some objections to the plaintiff's right to choose any path they wish and to ensure the exercise of civil litigation only before the civil judiciary, the trend is moving towards the plaintiff's right to choose any path they desire in order to assert their rights. They have the option to take the civil route, meaning they can file their claim before the judiciary specialized in civil matters. They also have the option to pursue the criminal route, meaning they can file a civil lawsuit before the criminal judiciary. Naturally, if they choose the civil route, the rules of civil procedure apply to the proceedings therein. If they opt for the criminal route, the decision will be governed by the rules outlined in criminal procedure law, unless the latter has ruled otherwise on a particular matter.
