Abstract

"Reparation" is more accurate as it encompasses all the means by which damage resulting from the violation of international law rules is remedied. As for the term "compensation," it is used to refer to reparation in its narrow sense, namely, the payment of a sum of money. The importance of this issue lies in the dispute over the term "reparation" and whether it can be described as a punishment or not. While some argue that the punitive nature of the obligation to repair is absent, as it is inconceivable for a state to be a criminal, others argue the possibility of achieving a punitive aspect of reparation. Therefore, we will present reparation as an obligation imposed by international law as a consequence of international responsibility in the first section.
