Abstract

The oath in the origin of the language:- the right hand, and it was called the oath because if they joined forces, each would take the oath of the other, and in Sharia law, the matter is fulfilled or confirmed by the remembrance of God Almighty, as one of His attributes. A vow in language is a commitment, but in Sharia, it is the obligation of a Muslim who is obligated to offer sacrifice, even if it is a conditional obligation, such as to God that I must fast for a day. Therefore, this research aims to shed light on oaths and vows in Islamic Sharia, in terms of the divisions of the oath and the exception to the oath and its conditions, atonement, in addition to Vows linguistically and legally, types of vows and their elements.
