This topic addresses the reading and analysis of some texts related to the crime of intentional murder in Libyan legislation, in terms of the powers and functions of both the legislator and the judge, within the framework of the principle of criminal legality. It also critiques the stance of the Libyan legislator regarding what has been established in the legislations issued concerning the crime of intentional murder and the prescribed penalties, as well as the role assigned to or entrusted to the judge in sentencing based on discretionary authority under both the Law of Qisas and Diyya and the Penal Code.
